This is a legal document describing your rights and obligations to use the services available under the domain www. diytogether.com.

This Agreement contains our policies of General Terms & Conditions, Services, Disclaimer of liability and Privacy Policy. Together they contain the whole of the agreement between us and you concerning your use of the DIY Together site and its services.

Please read this document carefully.

If you do not agree to be bound by this User Agreement, you may not use or access our services.

1. General Terms & Conditions

Access to and use of diytogether.com is provided by Net Together Ltd subject to the following terms:

1.1 Definitions

"DIY Together" - the web site identified by the url: www.diytogether.com

“DIY” – abbreviation of Do It Yourself

“Site” – the domain diytogether.com

“User” - by accessing any part of DIY Together you become a "user" of DIY Together

“Member/Registered user” – by registering you become a registered user or member of DIY Together

"Advertisers" – individuals or businesses who advertise on our site

"We”, “us” and “our" - the legal owners of DIY Together

“You, your” – the user, registered user or member

“Blog” - the DIY Together service called DIY Blog

All users and members are legally bound by this user agreement each time they access the DIY Together site, its sub-domains and its services. Before you may become a user of the DIY Together site you must read, agree with and accept all of the terms and conditions expressly set out below and those incorporated by reference.

We may make changes to these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by us. Your continued use of the Site after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

1.2 Registering & Membership

1.2.1 Registering

To contribute to our services you must register. To register you must be at least 16 years of age. If you are under 16 years old, you can use this service only in conjunction with and under the supervision of a parent or guardian. If you do not qualify, please do not use our services.

The DIY Together Services require different levels of registration.

Level 1

To use Level 1 services you need to provide a username and your email address. By doing so, you become a registered user and you may immediately contribute to the service.

Level 2

To contribute to Level 2 services you need to choose a username and a password. A validating link is emailed to you to activate your account. Once you validate it you become a member and you may contribute to all services up to Level 2.

Level 3

To participate in Level 3 services you need to complete the registration form and provide your full name and address. You will also be asked to choose a username and password, and a validating link will be emailed to you to activate your account. Once you validate it you become a member and you may contribute to and make us of all services up to Level 3. If you have already registered at Level 2, you may use the same username and password if you so wish. At this level you do not have to purchase or obtain tokens.

Level 4

Level 4 services require the same registration process as Level 3. In addition members need to obtain tokens which can then be used as payment for any of the DIY Together services that require them. You may then contribute to and make us of all services up to Level 4. Details of how to obtain or manage your tokens are explained here. If you registered at Level 3 you can upgrade your membership at any time by clicking on the “your account” link and filling in the appropriate fields.

Your personal details and your email address will not be accessible by or made available to any other users, registered users or members. You can change and update your details, including your password, in your profile at any time after you log-in.

1.2.2 Membership

Once you have registered you become a registered user/member of DIY Together. You may access the DIY Together services up to your registered level by using your username and password.

You may access the DIY Together services on the basis that:-

You acknowledge that we are not and cannot be held responsible for the behaviour of members, registered users or users - whether on the DIY Together web site or elsewhere. We only provide a venue where registered users and members can exchange information or express their opinion or offer, sell and buy DIY related items. Further terms and condition apply for each service.

For security or other reasons, we may require you to change password or other information that facilitates access to DIY Together and its Services.

1.2.3 Privacy

We take privacy of our members very seriously.

We will not directly make our members' personal information (name, address, email address) available to others on the DIY Together site.

We will not supply nor sell any of your data to third parties without your express permission.

Your details will be held in a secure database.

From time to we may email you with recommendations, news, changes of our services and other services we think you might find useful. You will be asked on the registration form to indicate if you do not wish to receive them. If you wish to unsubscribe from our newsletters please email us.

If you wish to cancel your membership please email us. We will terminate your username and password and they will become invalid immediately.

1.3 Use of Site

1.3.1 Material

For the purpose of this agreement "material" means any material published on DIY Together including, without limitation, all text, images and graphics of any nature whatsoever, regardless of whether the copyright or any other intellectual property rights rest with us or a third party.

Whether you are a member or a user you must not reproduce any part of DIY Together or transmit it to or store it in any other web site or disseminate any part of the material in any other form, unless we have indicated that you may do so.

You may download and print extracts from the material and make copies of these for your own personal use only. You are not allowed to download or print the material, or extracts from it, in a systematic or regular manner so as to create a database in electronic or paper form comprising all or part of the material appearing on DIY Together.

You warrant that any material that you submit to DIY Together is free from viruses and will not have any detrimental or contaminating effect upon this web site and/or any users or members of DIY Together.

You remain ultimately responsible for any material that you post on DIY Together and warrant that the comments or information supplied are true and accurate. You agree that you will not post any material that is subject to copyright or not otherwise owned by yourself.

You agree that you will not submit material which is untrue, defamatory, abusive, or otherwise in breach of any applicable law.

We reserve the right to remove from DIY Together any material submitted by you.

We reserve the right to use any material you may choose to send to us.

You shall indemnify us against any claims or losses, expenses or liabilities howsoever incurred (including legal expenses and other professional fees) arising as a consequence of your breach of any of the terms of this agreement.

1.3.2. Intellectual Rights

You acknowledge that all copyright, trademarks, and other intellectual property rights in and relating to DIY Together (including the material which is contributed by members) are owned by DIY Together. You may not copy, distribute, show in public or create any derivative work from DIY Together, or any of the material which is found on DIY Together unless properly licensed to do so by us.

The software that operates the DIY Together site is the sole property of IDMA. You may not copy or utilize any part of it. If you wish to licence this software please email here.

You forego any claim to the intellectual property rights, present or future, in any material that you submit to the DIY Together site and grant us the right to the royalty-free use of any such submission in any way that we think fit.

1.3.3 Site operation

There may be times when DIY Together becomes temporarily unavailable for technical reasons whether on a regular or irregular, scheduled or unscheduled basis or for reasons that are outside our control. We do not guarantee continuous uninterrupted access to our site and services.

1.3.4 Breach of this agreement

If, for any reason, we believe that you have not complied with any of this User Agreement, we may, solely at our discretion, immediately cancel your use or access to DIY Together and without giving you any advance notice. Any outstanding tokens or received payments will be forfeit without any refund.

We reserve the right to suspend or terminate any member's access to DIY Together, and/or to edit, or require the member to edit, material posted on DIY Together if the relevant member or material appears to us to be in breach of any provision of this Agreement. Any person whose membership has been suspended or terminated must not attempt to re-register without our prior consent.

We reserve the right to exclude any person from the DIY Together site whose membership has been suspended or terminated. Non-registered users who violate any part of this agreement or behave in any way that we consider inappropriate will be excluded from accessing the DIY Together site and may be reported to the appropriate organisations. We are firmly opposed to spamming and will take any action available within the law to prosecute them.

2. Services

We provide two types of services, those that are free of charge and those that are charged in tokens. Tokens need to be purchased prior to using those services that require them.

You may use, access and contribute to our services up to the level of your membership

You use our site and its services at your own risk.

2.1 FREE SERVICES

2.1.1 DIY NETWORK

The following terms and conditions are part of the main User Agreement and must be used in conjunction with the other policies.

The DIY Network is an online discussion board or forum to discuss DIY related topics. It is available to all users to read the ongoing discussions and topics.

To contribute to the DIY Network service you need to register at least at Level 2 ( see more about registration )

Members may contribute to the DIY Network only on the basis that you accept the following rules:

You acknowledge that we are entitled to withdraw any material posted in the DIY Network, whether based on information received from members or others or that we consider to be capable of breaching any part of this Agreement, or to bring DIY Together into disrepute.

We reserve the right to amend or delete any of your Personal Profile information that we deem inappropriate.

We reserve the right to suspend or cancel the membership of any members who violate these rules. Those whose membership has been suspended or terminated may be excluded from the DIY Together site.

All users and members accept that:-

We are reliant upon all users to notify us of anything that appears likely to breach this Agreement. Please let us know of any such misuse.

2.1.2 DIY REVIEW

The following terms and conditions are part of the main User Agreement and must be used in conjunction with the other policies.

DIY Review is a service to provide unbiased reviews from the public, for the public. It is available for all users to read and browse.

To contribute to the DIY Review service you need to register at least at Level 2 ( see clause 1.2.1 about registration )

Members may review any item in any category on the bases that you accept the following terms:

Reviews, comments and ratings are the subjective opinions of our members.

We are not responsible for the accuracy and truthfulness of any descriptions our members write.

All members and users act upon these reviews on their own risk.

Should you purchase anything as a result of these reviews - this is your own responsibility.

If you know that a review is maliciously intended or factually inaccurate or intentionally misleading please inform us.

We are not liable for any damages or losses (financial, physical, health) arising from the use of this venue to any individual or commercial entity.

2.1.3 DIY STORES

You will see advertising material submitted by third parties on DIY Together, particularly on the DIY Stores pages. Advertisers are solely responsible for the content of advertising material which they submit to us, including ensuring that it complies with relevant legislation. We accept no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy therein. Anything purchased or any information gathered from any sites that are advertised on, or linked to from the DIY Together site are governed by the rules and conditions of those sites. We take no responsibility whatsoever for their content.

 

2.1.4 DIY TIPS

The following terms and conditions are part of the main User Agreement and must be used in conjunction with the other policies.

DIY Tips is a service to provide useful tips and tricks to all DIYers. It is available for all users and members to browse.

To contribute to the DIY Tips service you need to register at least at Level 2 ( see clause 1.2.1 about registration )

DIY Together members may contribute to the relevant categories on the bases that you accept:

Tips are the subjective opinions of our designers and members.

Any material submitted to other DIY Together Services may be edited by us and published in the DIY Tips section.

You follow or act upon any advice, tips, ideas and other information at your own risk.

We are not responsible for the accuracy and truthfulness of any tips our members write.

We do not accept any liability for any damages or losses (financial, physical, health or otherwise) as a result of reading and/or following tips on this venue.

2.1.5 DIY BLOG

The following terms and conditions are part of the main User Agreement and must be used in conjunction with the other policies.

DIY Blog is a weblog (commonly known as blog) to write about DIY related topics.

It is available to all users and members.

To contribute to this service you do not have to become a member of DIY Together but by submitting a comment you become a registered user. To contribute to the DIY BLOG service you need to register at at least Level 1 ( see clause 1.2.1 about registration ).

Any user or member may contribute to the published articles and topics on the basis that you accept and will comply with the following terms and conditions:

You acknowledge that we are entitled to withdraw any material posted in the DIY Blog, whether based on information received from members or others or that we consider to be capable of breaching any part of this Agreement, or to bring DIY Together into disrepute.

We reserve the right to suspend or cancel the membership of any members who violate these rules and exclude them from using the DIY Together site. Registered users and users who violate these rules or behave in any way that we consider inappropriate will be excluded from accessing the DIY Together site and may be reported to the appropriate organisations. We are firmly opposed to spamming and will take any action available within the law to prosecute them.

2.2 Services Requiring Tokens

2.2.1 The Token Scheme

Tokens are required to use some of the services on the DIY Together site. Tokens have to be purchased in blocks. Each service using the token scheme has its own specified cost in tokens.

Further conditions apply to each service that requires the token scheme. Please read these under the appropriate section.

Paying for tokens

We reserve the right to change the number of tokens required for any of our services at any time. Should we decide to do so we will give 30 days notice of this by email to all members holding valid unexpired tokens.

Invalid tokens

Your tokens become invalid if /when

  1. they expire
  2. you have breached any part of this user agreement and your membership has been cancelled
  3. they are used in a fraudulent manner

2.2.2 DIY MARKET

The following terms and conditions are part of the main User Agreement and must be used in conjunction with the other policies.

The DIY Market is a venue which allows registered users to offer, sell and buy anything that is DIY related, at any time, from anywhere, in a variety of price formats. DIY related items mean anything to do with home improvement, home decoration, gardening, boats, auto-repairs, home appliances, furniture, furnishing, arts & crafts.

We do not permit the sale of any items that are inappropriate to our categories. It is your responsibility to ensure that your items for sale are not potentially hazardous, dangerous, unsafe, illegal, harmful to health or infringing any copyright or ownership - if you are not certain about this you must find out before you advertise your item on DIY Together We reserve the right to remove, without notice or recompense, any item that we believe is not suitable for our site or breach any part of this agreement. We do not permit the sale of any firearms; knives; weapons; hazardous chemicals, paints, varnishes & materials; illegal materials and substances.

To buy items via the DIY Market service you need to register at least at Level 3 – to sell items you need to be a register member at Level 4 ( see clause 1.2.1 about registration).

Members are allowed to sell and buy DIY related items via the DIY Together site on the basis that you accept and agree:

Fees

Part of this service is charged in form of tokens. You must register at Level 4 in order to obtain your tokens. Please read above regarding purchase of tokens

Use of Tokens

From time to time we may offer special promotions of the amount of tokens required to redeem per ad. These will be indicated on the relevant pages together with any conditions that may apply.

We have the right to withdraw any ad that we believe is not suitable – whether it is the item itself or the language in which it is described.

If we consider your ad to be misleading or in breach of any part of this agreement, your ad will be removed and your membership will be suspended or cancelled. If your membership is suspended or cancelled, all of your tokens will be taken away. You will not be refunded either by tokens or by money.

Liability

Please note that despite the above terms and conditions some members may provide information, or otherwise behave, in a way that is unreliable, misleading or even illegal. Some people may not be who they say they are. Given the nature of the internet we have no control over nor can accept any responsibility for the truth or accuracy of any material available on the DIY Together site and its services.

Should any dispute arise between buyers and sellers we shall not get involved nor can we be in any way held responsible for any part of it. In the event that you have any right, claim or action against any other user arising from that user's use of the DIY Together site and its services, you agree to pursue such right, claim or action independently of and without recourse to us, and you release us (and our parent, subsidiaries, affiliates, officers, directors, agents and employees) from all claims, liability, damages, losses, costs and expenses, including legal fees, known and unknown, arising from or in any way connected with such right, claim or action.

Without limiting any other remedies, we may suspend or terminate your account if we suspect that you have engaged or are about to engage in, or have been in any way involved in or linked to, fraudulent or other criminal activity in connection with the DIY Market or the DIY Together site.

We are not liable for any damages, losses arising from the use of this venue.

2.2.3 DIY HELP - ASK AN EXPERT

The following terms and conditions are part of the main User Agreement and must be used in conjunction with the other policies.

DIY Help – Ask an Expert is our service to provide expert advice, tips and ideas to those who submit a question. This service may be referred to as "ask a designer" as we currently only accept questions relating to Interior Decoration and Design. It is our intention to extend this service in the near future to other specialist areas.

To use this service you need to register at Level 4 ( see clause 1.2.1 about registration ) and become a member.

If you are an existing member at Level 2 or 3 you need to upgrade your membership and obtain at least one block of tokens.

If you already have tokens make sure that you have enough tokens in your account before submitting a question. If you don't you must purchase more tokens.

Having registered and/or purchased tokens you may submit your question on the QUESTION Card

Questions

Use of Tokens

Please read Clause 2.2 regarding the Token Scheme and purchase of tokens.

If we believe that your question is abusive, irrelevant, unlawful or in breach of any part of this user agreement, your membership will be suspended or cancelled and your tokens will be taken away. You will not be refunded either by tokens or by money.

From time to time we may offer special promotions of the amount of tokens required for this service. These will be indicated on the relevant pages together with any conditions that may apply.

We may use your question and our designers' answers as illustrative examples on our website. None of your personal details will be revealed.

We are not liable for any damages or losses arising from the use of this venue. Please read our Disclaimer of Liability for further details.

2.3 ADVERTISING

The following terms and conditions are part of the main User Agreement and must be used in conjunction with the other policies.

Our aim is to provide our users and members with useful information, contacts and sources to help them with their projects. We allow some advertising in certain Sections, but only adverts that are related to home improvement, decoration, remodelling, renovation, gardening and other DIY subjects. Advertisers must fill out an online form in order to advertise on our pages.

We endeavour to check out all sites before we put their advertising material on our pages – we only allow adverts for quality sites, products & services.

We do not permit advertising scrape sites, spamming sites, purely affiliating sites and sites that only exist to generate Adsense revenue. We do not permit the advertising of any firearms; knives; weapons; hazardous chemicals, paints, varnishes & materials; illegal materials and substances. We do not permit adverts for items or services that we consider to be inappropriate to our categories. We reserve the right not to allow ads on our pages entirely at our own discretion.

Individual, corporate and affiliate advertisers are solely responsible for the content of advertising material which they submit to us, including ensuring that it complies with relevant legislation. It is their responsibility to ensure that the product or service they advertise on our pages are not potentially hazardous, dangerous, unsafe, illegal, harmful to health or infringing any copyright or ownership.

Advertisers may submit short descriptions or a full article about their products & services. Any submitted material should be descriptive, objective and accurate. We do not allow any keyword stuffed text nor defamatory, misleading and blatantly promotional words. We reserve the right to change any submitted text that we consider spamming, misleading or does not comply with our terms & conditions.

We are not responsible for the content of any advertising material, its accuracy, truthfulness, safety or working order.

Advertisers may submit images and logos. These must be in jpg or gif format and have a maximum size limit. You can find out about these details on the Advertise with us page.

We reserve the right to change any submitted image that we believe is not suitable for our site.

We reserve the right not to publish any advertising material that we consider to be unsuitable in which case the advertiser will be refunded their payment.

Adverts will be published within 48 hours of receiving payment.

Liability

Anything purchased or any information gathered from any sites that are advertised on, or linked to from the DIY Together site are governed by the rules and conditions of those sites. We take no responsibility whatsoever for their content.

Advertisers are solely responsible for the content of advertising material which they submit to us, including ensuring that it complies with relevant legislation. We accept no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy therein. Please read our Disclaimer of Liability.

Prices & payment

Our advertising prices are published on the Advertise with us page. Minimum period may apply for putting any advertising material on our site. This may change from time to time and may be different for each Section. Before the advertising period expires, we shall send an email to remind the advertiser to renew their advert. If they do not renew, their advert will be removed.

We reserve the right to change the amount and conditions of our pricing without notice. Any adverts that have been prepaid will not be affected until their period expires. Should advertisers wish to renew their advertising period, the new rate will apply.

Refund

As soon as any advertising material is published on our site no refund will be given to the advertiser.

If we decide not to publish any advertising material the advertiser will be refunded their payment.

If it is brought to our attention after publishing that advertising material does not comply with our terms and conditions we reserve the right to withdraw it without repayment or compensation.

If an advertiser wishes to withdraw their advertising material after it is published on our site no refund will be made.

If an advertiser wishes to amend their advertising material after it is published on our site it is at our discretion as to whether this can be done and whether a charge is made for the amendment.

Offers

From time to time, we may offer special deals of prices or periods. These will have a limited period and only apply for the period the advertiser paid for.

3. Disclaimer of Liability

Please note that despite the above terms and conditions some members may provide information, or otherwise behave, in a way that is unreliable, misleading or even illegal. Some people may not be who they say they are.

We have no control over or responsibility for the truth or accuracy of any material available on DIY Together, whether provided by Members or others. We do not give any warranty as to the availability, accuracy, completeness, currency or reliability of the information and material published on DIY Together and expressly disclaim on behalf of DIY Together and any party contributing material (to the maximum extent permitted by law) all liability for any damage or loss resulting whatsoever and howsoever from your use of or reliance on the information and material published on DIY Together Accordingly, to the extent that the law permits, you release DIY Together and its directors, contractors and employees from all liability arising out of or in connection with DIY Together and the material included here by Members and other third parties.

Your use of DIY Together is entirely at your own risk.

You reveal any personal or contact details about yourself to other members at your own risk.

You can access other sites via links from DIY Together -we are not responsible in any way for any of their contents.

We give no warranties of any kind concerning DIY Together or the material therein. In particular, we do not warrant that DIY Together or any of its content is virus free. You must take your precautions in this respect as we accept no responsibility whatsoever for any infection by virus or other communication or by anything which has destructive properties.

You acknowledge that your use of DIY Together may be subject to interruption or delay. We do not give any warranty that DIY Together or the services offered through it will be error free, without interruption or delay, or free from defects in design or engineering.

We will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). DIY Together will also not be liable for any failure to perform of its obligations under this Agreement caused by matters beyond its reasonable control.

Without limiting the preceding Clause, during any period of twelve months, the aggregate liability of DIY Together under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed the an amount equal to the sums paid by you to us by way of token fees during the relevant period of twelve months, regardless of the cause or form of action.

Nothing in this Agreement limits DIY Together's liability for death or personal injury resulting from our negligence, or any other liability which may not by UK law be excluded. Any UK statutory rights you may have as a consumer remain unaffected.

You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of this Agreement by you or through a machine on which you access DIY Together

We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement. You may not assign or dispose of this Agreement without the written consent of DIY Together.

4. Privacy Policy

4.1 Data Protection

DIY Together is committed to protect the privacy of its members' information and complies with the data protection laws that apply in the UK .

4.2 Sharing and use of information

We will not directly make our members' personal details (including email addresses) available to others on the DIY Together site. Members however may exchange this information between themselves, if they so wish, via the DIY Network Private Messaging facility but not in the public forums. Sellers and buyers may exchange their contact details on the DIY Market service. It is their responsibility to make sure that such information is accurate and truthful. Any personal information you submit to your Personal Profile in the DIY Network is voluntary and is available to see by other members.

Any personal information you supply when registering will not be revealed to other members.

Your details will be held in a secure database.

From time to we may email you with recommendations, news, changes of our services and other services we think you might find useful. You will be asked on the registration form to indicate if you do not wish to receive them. If you wish to unsubscribe from our newsletters please email us.

We will only use your personal data for statistical purposes and for the benefit of the DIY Together members.

We will not supply nor sell any of your data to third parties without your express permission.

The only circumstances in which we will provide your personal data to a third party are:

4.3 Cookies

We may use cookies (small files on your computer) to hold your login and registration information.

Temporary session cookies may also be used. These cookies disappear when you leave the site.

Third party cookies may be used to track advertisements.

4.4 Security

We take measures to protect our member database and access to this database is restricted. However, it remains all members' responsibility:

If you wish to cancel your membership please email us. We will terminate your username and password and they will become invalid immediately.
